These Terms and Conditions (“Terms”) govern your access to and use of evoluter.in and the Evoluter application (together, the “Platform”), operated by Evoluters Technologies Private Limited, a company incorporated under the Companies Act, 2013 (CIN U62099GJ2026PTC171702) with its registered office at 303, Shyam Padmavati, Bhudarpura Road, Nr Shreyas Tekra, Ambawadi, Ahmedabad, Gujarat 380006 (“Evoluter”, “we”, “us”). “Evoluter” is the brand under which the company operates the Platform. By creating an account, subscribing, or otherwise using the Platform, you accept these Terms. If you do not accept them, do not use the Platform. These Terms, together with our Privacy Policy, form a binding electronic agreement under the Information Technology Act, 2000. No physical signature is required.

1. Eligibility

You may use the Platform if you are 18 or above and legally competent to contract under the Indian Contract Act,1872.

If you are under 18, you may use the Platform only with the consent and supervision of a parent or lawful guardian, who accepts these Terms on your behalf and is responsible for your use. You may not use the Platform if you have previously been suspended or removed by us.

2. Your account

You must provide accurate, current information when registering and keep it updated. Your account is personal to you. You may not share, sell, transfer or allow anyone else to use your login. You are responsible for all activity under your account and for keeping your password confidential. We may suspend or terminate accounts showing signs of credential sharing, including simultaneous access from multiple devices or locations inconsistent with individual use. Notify us immediately at team@evoluter.in of any unauthorised access.

3. What Evoluter provides Evoluter is an AI-assisted preparation platform for the UPSC Civil Services Examination and related competitive examinations. Depending on your plan, the Platform may include study plans, structured content, question banks, mock tests, answer and essay evaluation, doubt resolution, progress analytics and mentorship features. We are not a coaching institute and we are not affiliated with, endorsed by, or connected to the Union Public Service Commission or any government body. UPSC, and the names of any examination or authority referenced on the Platform, belong to their respective owners and are used only for identification.

4. No guarantee of results This section is important. Please read it carefully. Evoluter does not guarantee selection, rank, qualifying marks or any examination outcome. Results depend on your effort, preparation, aptitude and factors entirely outside our control. AI-generated evaluations, scores, feedback and recommendations are guidance, not authoritative assessment. They may contain errors, and they do not replicate official UPSC evaluation. Content may contain inaccuracies or become outdated. Syllabi, current affairs, patterns and official notifications change. Always verify against official UPSC sources and primary texts before relying on anything for an examination.

Any testimonial, success story or statistic shown on the Platform reflects an individual experience and is not a promise of similar results. You use the Platform’s outputs at your own discretion and risk.

5. Subscriptions, payments and refunds 5.1 Plans and pricing Plan features and prices are shown on the Platform at the time of purchase. All prices are in Indian Rupees and, unless stated otherwise, exclusive of applicable GST, which will be charged at the prevailing rate. Our GSTIN is 24AAJCE3984H1ZE and a tax invoice is issued for every transaction. We may revise prices for future billing cycles; existing subscriptions continue at the agreed price until renewal, and we will give notice before any change takes effect. 5.2 Payment Payments are processed through third-party gateways including Razorpay. We do not store your card or UPI credentials. Your use of a gateway is also governed by that provider’s own terms. 5.3 Auto-renewal Where you select a recurring plan, your subscription renews automatically at the end of each billing period at the then-current price, unless you cancel before the renewal date. You may cancel from your account settings at any time. 5.4 Cancellation Cancellation stops future renewals. Access continues until the end of the paid period. Cancellation is not the same as a refund. 5.5 No refunds All plans are non-refundable once payment is completed. Evoluter is a digital service. Access to study plans, question banks, AI evaluation and mentorship features is provisioned to your account immediately on successful payment, and the content is consumable from that moment. For that reason: No refunds are issued for any plan, at any time, after payment is completed — including where you change your mind, stop using the Platform, are dissatisfied with AI output or content quality, or are dissatisfied with your examination result. No refunds are issued for renewals, promotional or discounted purchases, or institution-purchased seats. Partial or pro-rated refunds are not issued for unused portions of a subscription period. Cancelling a subscription stops future renewals only. It does not refund the current period. Exceptions. We will refund, or credit your account, only in these cases: - A duplicate or double charge for the same plan. - A payment debited from you where access was never provisioned. - A verified failed or erroneous transaction.

• Where a refund is required by applicable law, or by our payment gateway or card network under their chargeback rules. To raise one of the above, email team@evoluter.in within 7 days of the transaction with your registered email address and the transaction ID. We will investigate and respond within 7 working days. Approved refunds are returned to the original payment method within 7–10 working days; gateway charges may be deducted. Before purchasing, please review the plan features, use any free trial available, and contact us with questions. By completing payment, you confirm you have read and accepted this no-refund policy. 5.6 Free trials Where offered, free trials convert to a paid subscription at the end of the trial period unless cancelled before it ends. One trial per user.

6. Acceptable use You agree not to:

7. Copy, download, record, screenshot in bulk, scrape, republish, resell or redistribute any Platform content

8. Share your account, or provide Platform content to non-subscribers, including in study groups, Telegram or WhatsApp channels

9. Use bots, scrapers, automated scripts or any programmatic access to the Platform, or attempt to access our APIs or models without authorisation

10. Attempt to extract, replicate, reverse engineer or fine-tune against our AI models, prompts or question banks

11. Circumvent paywalls, usage limits, rate limits or authentication

12. Upload unlawful, defamatory, obscene, hateful, infringing or malicious content, or anything that violates another person’s rights

13. Impersonate any person, or misrepresent your affiliation with any institution

14. Interfere with the Platform’s operation, probe its security, or introduce malware

15. Use the Platform to build, train or benchmark a competing product Breach of this section may result in immediate suspension or termination without refund, and we may pursue legal remedies.

16. Intellectual property 7.1 Ours All content on the Platform — text, question banks, model answers, study plans, video, graphics, the Evoluter name, logo, mascot, brand assets, software, models and underlying technology — is owned by Evoluter or its licensors and protected under Indian and international law. Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, personal, non- exclusive, non-transferable, revocable licence to access and use the Platform for your own examination preparation. No other rights are granted. 7.2 Yours You retain ownership of the content you submit — your answers, essays, notes and questions (“User Content”). By submitting it, you grant us a worldwide, royalty-free licence to host, store, process, display back to you, and use it to operate and improve the Platform, including as described in the AI processing section of our Privacy Policy. This licence ends when you delete the content or your account, except for anonymised copies already incorporated into model improvements and copies we must retain by law. You confirm that your User Content is yours to submit and does not infringe anyone else’s rights. 7.3 Feedback If you send us suggestions or feedback, we may use them without obligation or compensation to you.

17. Third-party services and links The Platform integrates third-party services (payment gateways, cloud infrastructure, AI providers, analytics) and may link to external sites. We are not responsible for their content, practices, availability or terms. Your use of them is at your own risk and subject to their agreements.

18. Availability and changes We aim for continuous availability but do not guarantee uninterrupted, error-free or secure operation. The Platform may be unavailable for maintenance, upgrades, third-party outages or events beyond our control. We may add, modify, suspend or discontinue features at any time. If we permanently discontinue a paid feature that

formed a material part of your plan, we will offer a pro-rated refund for the unused period.

10. Suspension and termination By you: you may stop using the Platform and delete your account at any time from account settings. By us: we may suspend or terminate your access, with or without notice, if you breach these Terms, if we suspect fraud or credential sharing, if required by law, or if continued provision would harm the Platform or other users. On termination, your licence ends immediately. Sections that by their nature should survive — intellectual property, disclaimers, limitation of liability, indemnity, governing law — continue to apply.

11. Disclaimer of warranties To the maximum extent permitted by law, the Platform and all content are provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, non-infringement, or that AI outputs will be correct, complete or suitable for your purpose.

12. Limitation of liability To the maximum extent permitted by law: Evoluter, its directors, employees and partners are not liable for any indirect, incidental, special, consequential or punitive damages, including loss of opportunity, loss of examination attempt, loss of rank, loss of data, or loss of profit or goodwill. Our total aggregate liability to you for any claim arising out of or relating to these Terms or the Platform is limited to the amount you paid to Evoluter in the three months preceding the event giving rise to the claim, or ₹5,000, whichever is higher. Nothing in these Terms limits liability that cannot be excluded under Indian law.

13. Indemnity You agree to indemnify and hold harmless Evoluter, its directors, employees and agents from any claim, demand, loss, liability or expense (including reasonable legal fees) arising out of your breach of these Terms, your User Content, your misuse of the Platform, or your violation of any law or third-party right.

14. Institution accounts Where you access the Platform through a coaching institute, college or organisation: The institution’s agreement with us governs seat allocation, billing and duration. The institution may view your enrolment, attempts, scores and progress within its batch. Your access may end when the institution’s subscription ends or when it removes you from its batch. You remain bound by these Terms in your individual capacity.

We will acknowledge within 24 hours and aim to resolve within 15 days.

16. Changes to these Terms We may update these Terms. Material changes will be notified by email or in-app notice at least 7 days before taking effect. Continued use after that date means you accept the revised Terms. If you do not accept them, stop using the Platform and cancel your subscription.

17. Governing law and jurisdiction These Terms are governed by the laws of India. Subject to the clause below, the courts at Ahmedabad, Gujarat have exclusive jurisdiction. Dispute resolution. Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved amicably within 30 days of written notice. Failing that, it shall be referred to arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Ahmedabad, Gujarat, and the language shall be English.

18. General Severability: if any provision is held unenforceable, the rest remains in force. No waiver: our failure to enforce a right is not a waiver of it. Assignment: you may not assign these Terms. We may assign them to a successor entity. Entire agreement: these Terms and the Privacy Policy are the entire agreement between you and Evoluter regarding the Platform. Force majeure: we are not liable for failures caused by events beyond our reasonable control.
